My landlord and one of my roommates (via landlord's approval) would smoke downstairs in the kitchen while the bedrooms were upstairs. When you come into the house you can't tell that there's anyone that smokes in the house at all and as far as I know it never bothered anyone. I think the landlord should threaten to kick the jerk out of the house if they keep it up-- after all, it IS their house and if they want it to smell like smoke then it's their choice really...
